Terms and Conditions

These terms tell you who we are, how we supply our books to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. Please read them before placing an order.

1. Who we are

This website is operated by Birr Series Publications Limited, a company registered in England and Wales at Companies House under company number 17330857.

We are not currently registered for VAT, so no VAT is charged on our orders.

2. These terms

By placing an order you agree to these terms. We may amend them from time to time; the version that applies to your order is the version published on this website when you place it. If you do not agree to these terms, please do not place an order.

3. How a contract is formed

Placing an order is an offer to buy from us. We will send an acknowledgement by email when we receive it. A contract comes into existence only when we send you an email confirming that your order has been dispatched.

If we cannot accept your order, we will tell you and will not charge you. This may happen because the item is out of stock, because of an unexpected limit on our resources, because we have identified an error in the price or description, or because we are unable to meet a delivery deadline you have specified.

4. Prices and payment

Prices are shown in pounds sterling and are the total you pay. Printed books are zero-rated for VAT in the United Kingdom, and we are not currently VAT registered, so no VAT is added at checkout.

We accept payment by credit or debit card and by Link, both handled by Stripe, and by direct bank transfer. Card payments are taken at the time of purchase. Where you choose bank transfer, your order is reserved while we wait for cleared funds and is dispatched once payment reaches us; we will contact you if payment has not arrived.

It is always possible that some of the items we sell are incorrectly priced. If the correct price is higher than the price shown, we will contact you for instructions before dispatching, and we may end the contract and refund you in full.

5. Wholesale and educational orders

Discounted wholesale and educational pricing is available to approved madrasahs, maktabs, institutes and trade customers who register through our Wholesale Registration page. Approval is at our discretion and may be withdrawn.

Orders placed on a wholesale or trade account are business-to-business contracts. The cancellation rights in section 7 apply to consumers only and do not apply to business customers.

6. Delivery

We deliver throughout the United Kingdom. Delivery is free on every order, with no minimum spend.

We aim to dispatch your order as quickly as possible and will email you once it has been sent. Any delivery dates we give are estimates rather than guarantees.

The goods are your responsibility from the time they are delivered to the address you gave us. You own them once we have received payment in full.

If nobody is available at your address to take delivery, the carrier will leave a note explaining how to rearrange delivery or collect the parcel. If, after a failed delivery, you do not rearrange delivery or collect the goods, we may end the contract and charge you the reasonable costs of storage and any further attempts.

7. Your right to cancel and return (consumers)

If you are a consumer in the UK, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel your order within 14 days, without giving a reason. The 14 days start the day after you receive the goods. If your order arrives in more than one delivery, they start the day after you receive the last one.

To cancel, tell us clearly by email at info@birrseriespublications.com before that period ends. You can use the model cancellation form in our Refund and Returns Policy, but you do not have to. You must then return the goods to us within 14 days of telling us.

If you cancel because you have changed your mind, you are responsible for the cost of returning the goods to us. We recommend using a tracked service and keeping proof of postage.

We will refund you within 14 days of receiving the goods back or, if earlier, of you giving us evidence that you have sent them back, using the same payment method you used. If you cancel before we dispatch your order, we will refund you within 14 days of you telling us. We may reduce the refund to reflect any reduction in the value of the goods caused by handling beyond what is necessary to establish their nature, characteristics and functioning.

8. Faulty, damaged or incorrect goods

Nothing in these terms affects your legal rights. Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality.

• Within 30 days of delivery you may reject faulty, damaged or incorrect goods and obtain a full refund.
• After 30 days, or if you prefer, you may ask for a repair or replacement. If that is not possible or does not fix the problem, you may ask for a price reduction or a refund.
• A fault that appears within six months of delivery is presumed to have been present at delivery unless we can show otherwise. You can make a claim for up to six years after delivery (five years in Scotland).

Please contact us at info@birrseriespublications.com with your order number and, where possible, a photograph. Where goods are faulty, damaged or incorrectly supplied, we pay the cost of return — the charge in section 7 applies only when you simply change your mind.

9. Your account

If you create an account you are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly if you believe your account has been used without your permission. We may suspend or close an account where these terms have been breached.

10. Intellectual property

All content on this website, and the text, layout, typography, illustrations and design of the Qaʿidah of Birr Series and our other publications, are owned by or licensed to Birr Series Publications Limited and are protected by copyright. You may not reproduce, photocopy, scan, redistribute or create derivative works from any part of our publications without our prior written permission.

Purchasing a copy grants you the right to use that copy. It does not transfer any rights in the work itself, and does not permit classroom photocopying or digital distribution. Institutes needing multiple copies should use our bundle pricing.

11. Our responsibility for loss or damage

We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights in relation to the goods.

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.

Where you buy as a business, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity.

12. Events outside our control

We are not liable for any failure or delay in performing our obligations that is caused by an event outside our reasonable control. We will contact you as soon as reasonably possible to let you know, and will take steps to minimise the delay.

13. Complaints

If you are unhappy with our goods or service, please email info@birrseriespublications.com with your order number and we will look into it and reply as quickly as we can.

14. Governing law

These terms are governed by the law of England and Wales, and you and we both agree to the exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country in which you live.
